Just read that and was thinking...whats the harm in putting someone on trail? Are we afraid we dont have ANY REAL chance of finding them guilty? I get the whole "War on Terror" and what not. But come on! No Trail by Jury, its un-American, If we stoop to their level we lose that what makes us better.

Actually, the answer is yes.... the US government is afraid that they will get off. Some of these guys are clearly hardcore terrorists, but because of the way they were captured and then interrogated, they will probably have to be released. So, the US holds them as de facto POW's.
But they're not being held as criminals, they're being held as enemy combatants. They were captured in combat, just like any other soldier. Enemy combatants have never been tried in civilian court and they really have no business being tried there. And really, as I understand the Geneva Convention as taught to me in the military, these clowns aren't even protected by that document. They serve in no standing army, they have no allegiances to any one nation (unless one were to call Islam a nation, but that's politically incorrect, now isn't it) The Supreme Court, attempting to show compassion and how America is more civilized, has made it exceptionally difficult for us to execute any war. God forbid we go to war with Iran or North Korea, should we try Kim Jong Il in federal court if we captured him?

THe unabomber was basically doing the samething. He was blowing people up for his own crazy cause. He would be held in trail.
The OK City Bomber and his gang have seen thier day in court. But they were armed they werent in a standing Army. Its basically the same actions but they were Americans so it wouldnt be okay to throw them into some obscure Military Prison in God knows where.

Innocent untill proven guilty? Whatever happened to that? OJ was a "hardcore" killer but he got his day in court, it sucks he got off but what'cha going to do? Good or bad we have a system that stands for something, and to ignore isnt a good sign of things to come.
I just worry that we are living in an America where secert Prisons, Torture, and Goverment Spying are becoming a GOOD thing.

These guys were captured in battle, fighting against coalition forces.
This includes the definition of POW (http://www.unhchr.ch/html/menu3/b/91.htm) under the Geneva Convention- Article 4.
Islamic Jihadists don't fit. The Unabomber and the OKC crowd were blowing people up just the same, but they weren't taken in combat of war and fall under the jurisdiction of the courts. Just like these cats down in Miami (the seven Al Qaida wanna-bes) they're being charged in civilian courts.

They were captured as enemy fighters, not criminals. The government believes that means they should not be tried as criminals, or have the rights of criminals.
Though, there are some good arguments against that notion. It will be interesting to see this play out.
